This Acceptable Usage Policy is a policy regarding the use of Herza Europe, Ltd (Herza Cloud) facilities which are included in the services used by customers.

WEBSITE / SERVER CONTENT

Customers are prohibited from uploading website content that is of a nature and/or related to:

1. Pornography, gambling, SARA, insults, and public indecency
2. Things that can cause disputes, unrest and terror
3. Material containing copyrighted elements, trademarks without the owner’s permission, including DMCA (Digital Millennium Copyright Act)
4. Material that can be used for things that disturb all parties
5. Ponzy, pyramid scheme, fraud, phishing and fraud
6. Transactions/purchases of medicines online without a valid permit (SIA) or without approval from PharmacyChecker or BPOM
7. Other materials that do not comply with the laws and regulations of the Republic of Indonesia
8. Material that is prohibited by the ISP or Datacenter

HOSTING ACCOUNT USE

Customers are prohibited from using hosting accounts (including Shared Web Hosting, Reseller Hosting, VPS Hosting, Dedicated Servers and Colocation) for:

1. Sending mass e-mails and/or SPAM (more details will be explained in another article)
2. Installing IRC BOT, PsyBNC, and IRC related processes
3. Web Proxy, Mail Proxy, and other types of proxies on Shared Web Hosting services
4. Installing Mikrotik CHR on regular VPS services is prohibited. We offer a  Mikrotik VPS package  specifically for Mikrotik CHR use.
5. Regular VPS usage for VPN/tunneling or streaming is prohibited. We offer  Tunneling/VPN VPS packages  specifically for Tunneling/VPN and Streaming.
6. Download files using hosting facilities either via shell, ssh, or other methods on all Herza Cloud services.
7. Using Shared Web Hosting as a place for storing files / backups / online storage that has nothing to do with your website.
8. Bit Torrent or other Peer to Peer applications on Shared Web Hosting services.
9. Perform DDOS, port scanning, sniffing, and system exploits on all Herza Cloud services
10. Used without a registered public domain (spoofing). Hosting accounts with expired or available domains (which can be registered by anyone) will have their services terminated.
11. Storing files that are prohibited in the “Website Content” article
12. Cryptocurrency mining on all VPS & Dedicated Server services
13. Types of use that are prohibited by the ISP or Datacenter
14. The inode limit for a single hosting account is 50,000 inodes, with a tolerance limit of up to 75,000. When your account’s inodes reach this limit, backups will not be performed, potentially leading to data loss in the event of server failure, and Herza.ID will not be responsible for this.
15. Daily backups will only be run on accounts that use less than 5 GB of disk space and/or less than 75,000 inodes.
16. Total email usage on one hosting account is not permitted to exceed 1 GB.

On the  Free Web Hosting service , the following resource usage policies apply:

1. All Free Web Hosting registrants MUST VERIFY their registered accounts to prevent any untoward incidents. This verification includes verifying the identity of the person responsible (KTP) and the registered corporate permit.
2. Free Web Hosting is only intended for organizations engaged in social or non-commercial activities. If your account is discovered to be being used for commercial purposes, Herza.ID will terminate your account, including backup files.
3. Free Web Hosting may not be used for the provision of the following services:
   • Streaming Video
   • Online Storage
   • File Sharing
   • Image Hosting

USE OF E-MAIL FACILITIES

Customers are prohibited from using e-mail facilities and other facilities that can be used to send e-mails for:

1. Sending SPAM and/or Unsolicited Mail, or intentionally receiving both of these
2. Sending mass e-mails for any reason and/or mail bombing
3. Sending more than 100 emails per hour
4. Sending materials listed in the prohibited categories in the article “Website Content”
5. Types of e-mail that are prohibited by the ISP or Datacenter

HOSTING RESOURCE USE

Customers are prohibited from using hosting resources in the form of CPU, RAM, Storage, and Network excessively so that it has the potential to or has disrupted services to other customers.

Server Abuse

Any attempt to damage or cause damage to Herza.ID servers or customers is strictly prohibited, such as the use of VPS or Dedicated Servers with an average CPU load above 80% consecutively for 59 minutes.

Herza.ID will respond strictly to any unauthorized use or attempted use of an internet account or computer. These attempts include “internet fraud” (tricking others into giving up their passwords), password theft, port scanning, malware and trojan distribution, and more.

WEB APPLICATIONS & SCRIPT – Any outdated and actively exploited web applications will be shut down immediately without prior notice. YOU are responsible for and must regularly evaluate YOUR web-based applications and scripts to ensure their security and integrity.

Storage Abuse

Herza Cloud will not tolerate any form of storage space abuse. At least 90% of YOUR web pages (“HTML”) must be ‘linked’ to files (GIF, JPEG, etc.) stored on Herza.ID servers. Websites found to contain/or contain no HTML documents, a large number of unlinked files are subject to file deletion or account cancellation at the discretion of Herza.ID Management (“MANAGEMENT”), with or without prior notice.

Herza Cloud does not allow for short-term disk usage. Herza Cloud will adjust your daily disk quota to 130% of your current disk space usage, with a minimum quota of 1GB.

Bandwidth Abuse

Herza Cloud’s purpose is to provide high bandwidth for transferring web documents, not offsite storage for electronic files.  Herza Cloud’s affordable VPS service  is not intended for tunneling/VPN use. We provide  Mikrotik VPS  and  Tunneling/VPN VPS  for both VPN and tunneling purposes.

If you violate these terms, you will be notified and given 24 hours to resolve the issue. Failure to do so will result in you being billed for overages and may result in the suspension or cancellation of your service without compensation.

SANCTIONS FOR VIOLATIONS

1. If, according to Herza Cloud’s assessment, the violation committed by the customer is minor, Herza Cloud will send a warning via e-mail to the customer concerned.

3. Herza Cloud has the right to terminate the contract without any guarantee for the return of payment and refuse to provide the guarantee stated in  the Terms of Services.
4. Herza Cloud has the right to suspend or terminate services without prior notice.
5. Herza Cloud reserves the right to impose fines on customers who intentionally commit violations.
6. Herza Cloud has the right to take over domain ownership if the violation is serious and done intentionally
7. Herza Cloud will charge a penalty of Rp. 300,000 (Three Hundred Thousand Rupiah) for every Abuse report we receive relating to any form of violation.
